A scientific committee at the College of the Law / University of Karbala discussed the doctoral thesis of the student Hassanein Makki Joudi, tagged “legal organization of the non-morphological paper”, a comparative study.
The study aims to address the legislative defect that affected the texts regulating the non-monetary commercial paper, which was represented by the legislative deficiency, as the legislator did not indicate the types of this paper, which was shrouded in ambiguity in the texts of the law. On the other hand, only one article was dealt with in the regulation, which is Article 185 of the Trade Law in force.
The study also showed that this type of commercial paper is the most prevalent in commercial dealings because it provides credit and guarantees fulfillment and speed in circulation by moving according to commercial methods such as endorsement or manual handling, which contributes to supporting commercial credit.

The researcher reached several results, the most important of which are:

  • The Iraqi legislator in the Trade Law No. 30 of 1984 in force has set a general rule for the non-exchange commercial paper, and this rule was represented by Article 185, but he did not specify the non-exchange commercial papers, but rather left the field open for any paper that meets the conditions of this article.
  • The researcher also concluded that the non-exchange commercial paper is considered a commercial paper, although some have denied its commerciality, but the law considers its commercial applications as a certificate of deposit, insurance and letter of guarantee.
    The researcher suggested a number of proposals representing a project to amend the commercial law with regard to the issue of regulating the non-exchange commercial paper and related articles.
